Commissioners Unaware of Claim

National Association of Realtors

POSRP's President, AJ Chamberlin, spoke at the November 2004 conference for National Association of Realtors (NAR).  She gave a presentation on RS 2477 to the Land Use, Property Rights, and Environment (LP&E) Committee.  The presentation was well received.  Many people were shocked to hear about this statute, its ramifications, and liability for realtors and property owners alike.  Some of the attendees were aware of RS 2477.  The Chair of the NAR LP&E Committee is from Utah and indicated that he knew that this was happening all over in Utah.  One realtor from Alaska said that property owners there don't know exactly where the RS 2477 route is since no one can tell in the winter time with snow on it.  He indicated that at least a law was passed in Alaska to protect private property owners from liability if a snowmobiler gets hurt.

Visit to Washington D.C.

AJ Chamberlin, POSRP President, traveled to Washington D.C. to speak with lawmakers there regarding RS 2477. 

Testimony in Utah

The House Subcommittee on National Parks heard testimony in St. George Utah on RS 2477.  One of the items discussed is the MOU between Utah and the Department of the Interior.  Concerned parties from California also appeared to testify.

Colorado Counties

AJ Chamberlin spoke to a group of Colorado county commissioners regarding RS 2477.  The commissioners were a subcommitte of Colorado Counties Inc. and were drafting a proposed resolution for the  CCI Board to consider.  The final letter from CCI to the Colorado Department of Natural Resources included many of the concerns POSRP put forth regarding private property owners.

Summit County has passed its own resolution and Pitkin County has a draft resolution under consideration.  Both of these resolution recognize the need for clear legislation at the federal level to allow for local decisions regarding RS 2477 potential right-of-ways.

 

Colorado Resolution

On March 10, 2004, a resolution passed the Colorado Senate, introduced by Senate President John Andrews, calling for federal legislative action to clear up ambiguities in a civil war era law that is being used to claim “public highways” across private land and some of Colorado’s most precious protected areas such as Dinosaur National Monument and Browns Park National Wildlife Refuge.  This resolution adds to the growing clamor from property owners, local elected officials, hunting organizations and conservationists for a fair, balanced and timely resolution to this growing problem.
